WHAT WE DO

Mahogany Minds, LLC, a Texas limited liability company (“Mahogany Minds”, “we”, “us”, “our”) provides research to help our clients understand how people perceive various brands, products, services, and marketing campaigns. To achieve this, we create, analyze, and administer surveys, questionnaires, focus groups, user studies, and similar research tools (collectively “Surveys”) to provide insights to our clients. Using the results of our Surveys, we help our clients understand the anonymized characteristics and demographics of the people who visit their sites, use their products and services, or see their advertising.

 

PURPOSE OF THIS PRIVACY POLICY

At Mahogany Minds, we understand your privacy is important. This Privacy Policy is designed to help you understand what information we collect about you and how we use it. 

 

WHEN DOES THIS PRIVACY POLICY APPLY TO YOU?

This Privacy Policy applies to you if you: (1) visit any of our websites (including www.mahogany-minds.com), apps or social media pages; (2) interact with our marketing communications or otherwise communicate or engage with us; or (3) participate in a Survey (collectively, our “Services”). Any information that we collect is subject to our Privacy Policy in effect at the time that information is collected.

 

By using our Services, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree with this Privacy Policy, you may not use our Services. When we refer to you or your, we mean the individual accessing or using the Services or the legal entity on behalf of which such individual is accessing or using the Services, as applicable.

 

This Privacy Policy applies unless the Services displays, references, or links to a different privacy policy. It is important that you read this Privacy Policy together with any other privacy policy we may link, reference, or provide on specific occasions when we are collecting or processing Personal Data about you so that you are fully aware of how and why we are using your Personal Data. This Privacy Policy supplements other notices and privacy policies and is not intended to override them.

 

This Privacy Policy applies to you irrespective of where you are located. Certain additional parts of the Privacy Policy will apply to you where you are a resident of the European Economic Area (“EEA”), United Kingdom (“UK”) Switzerland, California, or Nevada. These additional parts do not apply to everyone.

 

1. WHAT IS PERSONAL DATA?

 

References in this Privacy Policy to data, personal information, or information are all references to Personal Data. “Personal Data” means any information relating to you that can identify you. It does not include data where the identity has been removed, such as anonymous data or non-personally identifiable information, such as aggregate statistics.

 

2. WE COLLECT PERSONAL DATA FROM THREE GROUPS

 

The Personal Data we collect from you will depend on how you use our Services. We group individuals or businesses that use or access our Services into the following categories:

 

• “Client” is the business or individual who engages us to create, analyze and administer Surveys. Clients may collaborate, comment or review Surveys created by Mahogany Minds.
   
• “Respondent” is the individual who receives and responds to a Survey from Mahogany Minds powered by the Services.
   
• “Visitor” is anyone who visits pages of our websites, social media profiles or apps and is not necessarily a Client or Respondent.

 

3. WHO IS MY DATA CONTROLLER?

 

This Privacy Policy applies to you when we act as a data controller of your Personal Data - when we control how your Personal Data is collected, stored and processed. 

 

Mahogany Minds is the data controller of your data, and the use of that data is governed by this Privacy Policy if:

 

• You are a Client or Visitor providing information through our Services (such as completing a contact form on our website, setting up an account or submitting feedback).
   
• You are a Respondent providing information through a Survey directly created or administered by Mahogany Minds.

 

Client is the data controller of your data, and Mahogany Minds is the data processor of that data if:
 

• You are a Respondent providing information through a survey, questionnaire, form, or similar research tool that is directly created or administered by a Client. When a Client is the data controller, we are not responsible for the Client’s privacy or security practices, which may differ from those outlined in this Privacy Policy. We process that information as instructed by our Clients, in our capacity as a service provider/data processor, in accordance with the terms of our client agreements. In this instance, Respondents should refer to our Clients’ privacy policies for information about how our Clients collect, use and share information. 

 

4. DATA WE COLLECT YOU VISIT OUR WEBSITE OR CONTACT US

 

WHAT DATA WE COLLECT

When visiting our website, contacting us, creating an account, or otherwise engaging with us other than responding or participating in a Survey, you provide us with data. The information below sets out examples of Personal Data we may collect; however, in practice we may not collect all of these examples but only selected examples. The information we collect may include:

 

• Identity Data: Information that can be used to identify you, such as your name, username, email,  date of birth, and demographic information, such as your age or gender.
• Contact Data: Information that can be used to contact you, such as your address, email address, and phone number.
• Financial Data: Your income or when you make a purchase your bank or payment details when you make a purchase.
• Customer Data: Your usage or purchase details of our products or services, including our free content (for example, online webinars, e-courses, downloads, mailing lists).
• Technical Data: Your IP address, login, browser type, browser plug-ins, time zone, location, and operating system. When you access the Services by or through a mobile device, we may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device's unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data. 
• Marketing and Communication Data: Your preferences in receiving marketing communications from us and our third parties, as well as your communication preferences.
• Client Data: Information about how you use or are granted access to our Services, your username and password, purchases or orders, how long you are on our pages, URL clicks, your attendance at webinars or other events hosted by us, and your interests, preferences, feedback and survey responses.
• Social Networking Data: Information from social networking sites and apps, including  TikTok, Facebook, Instagram, Linkedin, Twitter, or other social networks or apps not named specifically here, which may include your name, your social network username, location, email address, age, gender, profile picture, and any other public information.
• Aggregated Data: We also collect, use and share Aggregated Data, such as statistical or demographic data, for any purpose. Aggregated Data could be derived from your Personal Data but is not considered Personal Data in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your user data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect Aggregated Data with your Personal Data so that it can directly or indirectly identify you, we treat the combined data as Personal Data, which will be used in accordance with this Privacy Policy.

 

HOW WE COLLECT THIS DATA

We use different methods to collect data from and about you, including through:

 

Information you provide directly to us. We may collect data about you if you voluntarily provide us with such information in connection with the following:

Information we collect automatically from your use of our Services. WHY WE COLLECT AND HOW WE USE THIS DATA

Under data and privacy laws, we are only allowed to use your data for specific reasons and where we have the legal basis to do so.  Your data allows us to offer you certain products and services, including the use of our Services, to fulfill our obligations to you, to customize your interaction with us and our Services, and to allow us to suggest other products and services we think might interest you. To the extent we process your data, we do so to serve our legitimate business interests (such as providing you with the opportunity to purchase our goods or services and interact with our Services). 

 

We may USE Personal Data for the following purposes: 

• To provide and maintain our Services, including to monitor the usage of our Services. 
• To manage your account: to manage your registration as a user of the Services. The Personal Data you provide can give you access to different functionalities of the Services that are available to you as a registered user. 
• For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or services you have purchased or any other contract with us through the Services. 
• To contact you: To contact you by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application’s push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation. 
• To provide you with information including news, special offers and general information about other goods, services and events that we offer that are similar to those that you have already purchased or enquired about unless you have opted not to receive such information. 
• To manage your requests: To attend and manage your requests to us. 
• Other purposes: We may also use the information collected from you in other ways and for other purposes that are described to you at the point of collection or for which we otherwise have obtained your consent.

 

We may share your data with third parties for the purposes for which it was collected and in certain situations. In particular, we may share your data with third-party processors as needed to serve our legitimate business interests, which include administration of our Services, administration of your account, entering into contracts with you, communicating with you, taking orders for goods or services, delivering our goods and services, identifying trends, protecting the security of our company and Services, and marketing additional goods and services to you.  The legal basis for our disclosure of your data is both your consent to this Privacy Policy and our own right to protect and promote our legitimate business interests. 

 

We may SHARE your Personal Data in the following situations: 

• With service providers and advisors: We may share your personal information with service providers to monitor and analyze the use of our Services. Service provider refers to any third-party company or individual employed by Mahogany Minds to facilitate the Services, to provide the services on behalf of Mahogany Minds, to perform services related to the Services, or to assist Mahogany Minds in analyzing how the Services are used.
• For business transfers: We may share or transfer your personal information in connection with, or during negotiations of, any merger, sale of business assets, financing, or acquisition of all or a portion of our business to another company. We will provide notice before your Personal Data is transferred and becomes subject to a different Privacy Policy.
• With affiliates: We may share your information with our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include our parent company and any other subsidiaries, joint venture partners or other companies that we control or that are under common control with us. 
• With business partners: We may share your information with our business partners to offer you certain products, services or promotions. 
• Legal Compliance: We may share when we believe it is necessary to comply with applicable laws and regulations, respond to a subpoena, search warrant, or other lawful requests, protect you or other users, operate and maintain the security of our Services and related business operations, and protect our rights or property.
• Aggregate or De-Identified Information: We may share information in aggregate/or anonymous form that cannot reasonably be used to identify an individual. For example, we may disclose aggregated user statistics (i.e., the total number or percentage of users from a particular geographic region) in order to describe our Service to current and prospective partners and other third parties and for other lawful purposes.
• With other users: When you share personal information or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside. If you interact with other users or register through a third-party social media service, your contacts on the third-party social media service may see your name, profile, pictures and description of your activity. Similarly, other users will be able to view descriptions of your activity, communicate with you and view your profile. 
• Other purposes: We may disclose your Personal Data as necessary to comply with any legal obligation or to protect your interests or the vital interests of others or our company.

5. DATA WE COLLECT FROM RESPONDENTS WHEN YOU PARTICIPATE IN A SURVEY

In addition to the information in Section 4, we may collect the following:

• Survey Data: When you complete a Survey, we collect your answers to the questions in the Survey.
• Identity Data: When you participate in a Survey, we will ask you various things about yourself, including your name or email address. While our Survey may ask for information about you and your consumer behavior and beliefs, we do not use this information to personally identify you.
• Aggregated Survey Data: We may aggregate your Survey Data with the Survey Data we receive from other individuals completing our Survey to produce Aggregated Survey Data. We provide access to such Aggregated Survey Data to our Clients as part of the service we provide to them. Aggregating data in this way enables us and our Clients to analyze aggregated survey responses to understand consumer behavior. While such Aggregated Survey Data may be derived from Personal Data, its aggregated nature means that it is not possible for our Clients to identify an individual Survey Respondent from the information provided to them.
• Special Category Data: Certain of your Survey responses may reveal information about you that is considered a “Special Category” of Personal Data. We will only ask questions that relate to Special Categories of data where we are permitted to do so by the laws of your jurisdiction. We will also give you an option to “prefer not to say” or similar as a response to any questions that concern any Special Categories of data. Special Category Data reveal the following details about you:
  • race or ethnicity
  • health
  • sex life
  • sexual orientation
  • religious or philosophical beliefs
  • trade union membership 
  • genetics
  • biometrics (where used for ID purposes)

 

HOW WE COLLECT THIS DATA

In addition to the methods in Section 4, we use the following methods to collect data from and about you:

• Information you provide directly to us. You provide us with your Survey Data when you voluntarily participate in a Survey and additional Surveys.
• Information we collect automatically from technologies or interactions. As you complete the Survey online, we may automatically collect Technical Data about your equipment, browsing actions and patterns. We collect this Personal Data by using cookies and other similar technologies. We may also receive Technical Data about you if you visit other websites employing our cookies. 

 

WHY WE COLLECT AND HOW WE USE THIS DATA

When you participate in a Survey, we will only use your Personal Data when the law allows us to. The following is a description of how we plan to use your Personal Data and the legal bases we rely on to do so:

• To carry out our business operations as a data insights company by creating, analyzing and administering Surveys and arranging to collect your Survey responses, including in raw format
• To process Survey Data
• To analyze the effectiveness and accuracy of our Clients’ advertising campaigns, product or service development, new innovation spaces, and general consumer research and development
• To assist our Clients in understanding how you interact with their advertising campaigns, product or service development, new innovation spaces, and general consumer research and development
• To model data to help Clients understand the demographics of end users interacting with their advertising campaigns, products and services, and new innovations spaces
• To invite you to participate in future surveys where we have determined that your additional Survey responses may be of particular interest to our Clients

 

Some of our Clients may request access to your Survey responses in raw format that hasn’t been anonymized, which could result in Clients being able to re-identify you. Clients will only be able to re-identify you if they already have access to your Personal Data as a result of their relationship with you (because you are a consumer of theirs, for example) and where we’ve given you notice that we will be sharing your Survey responses in raw format with any Client. Any processing of your Survey responses in raw format by the Client will be done in accordance with the Client’s own privacy notice below.

 

6. DETAILS OF DATA WE PROCESS WITH SERVICE PROVIDERS OR SUBPROCESSORS

 

In some cases, we use third-party technologies and services to deliver the best services to our Clients, Respondents, and Visitors. At the time of this writing, we may receive or process Personal Data about you from the third-party services as set out below (updated from time to time and available from us upon request).

 

ANALYTICS

We may use third-party service providers to monitor and analyze the use of our Services, such as those of Google Analytics. Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network.

EMAIL MARKETING

We may use your Personal Data to contact you with newsletters, marketing or promotional materials and other information that may interest you. You may opt out of receiving any or all of these communications from us by following the unsubscribe link or instructions in any email we send or by contacting us. We may use email marketing service providers to manage and send emails to you.

 

PAYMENTS

We may provide paid products and services within the Services. In that case, we may use third-party services for payment processing (e.g., payment processors). 

 

We will not store or collect your payment card details. That information is provided directly to our third-party payment processors, whose use of your personal information is governed by their Privacy Policy. 

 

7. HOW WE PROTECT YOUR DATA

 

To protect your Personal Data, we have implemented and strive to maintain reasonable, commercially acceptable safeguards appropriate to the nature of the information we collect and store. However, no website, internet transmission, method of electronic storage, or security system is completely secure. We urge you to take appropriate steps to keep your Personal Data safe, such as choosing not to send Personal Data through insecure email and closing your browser when finished using our Services or those of any other website on a shared device or unsecured network.

 

8. HOW LONG WE KEEP YOUR DATA

 

We will only retain the Personal Data you provide for as long as reasonably as needed to fulfill the purposes for which we collected it and as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Our actual retention periods can vary widely based on the data type, the relationship's nature, and our legal and other obligations.

 

9. YOUR CHOICES AND RIGHTS ABOUT YOUR DATA

 

YOU DON’T HAVE TO PROVIDE US WITH YOUR DATA

You can choose not to provide us with any Personal Data. Where we are required to collect Personal Data by law, or if it’s necessary for us to provide certain aspects of our Services, if you do not provide us with that data when requested, that may prevent us from providing you with access to certain parts of our Services. In this case, we may have to cancel a product or service you have with us, but we will notify you if this is the case at the time.

 

YOU MAY REQUEST ACCESS, CORRECTION,  OR DELETION OF YOUR DATA

You may request access to, correction of, or deletion of your Personal Data by contacting us as described at the bottom of this Privacy Policy. We may decline your request if: (i) we are unable to verify you are the person to whom the data relates, (ii) it could adversely affect the rights of another person, or (iii) it is unreasonable, excessive, or prohibited.

 

YOU MAY TURN OFF COOKIES

We may send cookies to your computer in order to uniquely identify your browser, help us improve our Services, and otherwise enhance your experience. A “cookie” is a small file of letters and numbers stored on your browser or your device's hard drive.

YOU MAY OPT OUT OF MARKETING

You can ask us or third parties to stop sending you marketing messages at any time by following the opt-out links on any marketing message sent to you or by contacting us at any time. 

 

Where you opt out of receiving these marketing messages, this will not apply to Personal Data provided to us as a result of a product or service purchase.

 

YOU MAY UNSUBSCRIBE 

If you want to unsubscribe from receiving emails from us or close your account as a Respondent, you may do so anytime. Each email from us includes instructions for unsubscribing from email communications. Our Survey website and/or platform includes instructions for closing your account or unsubscribing from the platform.

 

YOU MAY OPT OUT OF THE SALE OF PERSONAL INFORMATION

You have the right to opt out of our sale of your personal information or our sharing of your personal information for behavioral advertising purposes.

 

10.  U.S. STATE-SPECIFIC RIGHTS

 

If you reside in a state that provides specific data privacy rights, you may contact us at info@mahogany-minds.com to exercise such rights. We may have a reason under the law why we do not have to comply with your request or may comply with it in a more limited way than you anticipated. If we do, we will explain that to you in our response.

 

DISCLOSURES FOR CALIFORNIA RESIDENTS

The California Consumer Privacy Act (“CCPA”) provides California residents with certain rights. 

 

Shine the Light. If you reside in California, the CCPA provides that you have the right to request more detailed information about how your personal information is shared with third parties for direct marketing purposes. If applicable, this information would include a list of the categories of Personal Data that was shared and the names and addresses of all third parties with whom we shared information in the preceding calendar year. Children. We do not sell the personal information of users we know to be less than 16 years of age unless we receive affirmative authorization (the "Right to Opt In") from either the minor who is between 13 and 16 years of age or the parent or guardian of a child under 13 years of age.

 

DISCLOSURES FOR NEVADA RESIDENTS

Nevada residents who wish to exercise their sale opt-out rights under Nevada Revised Statutes Chapter 603A may submit a request to this designated address: info@mahogany-minds.com. However, please know we do not currently sell data triggering that statute’s opt-out requirements.

 

11.  INTERNATIONAL TRANSFER OF YOUR DATA

 

Mahogany Minds and its service providers may process, transfer, and store Personal Data on servers located in several countries, including the United States and India. Where we transfer your Personal Data, the privacy laws may not be as protective as those in your jurisdiction; however, we will take reasonable steps to ensure that appropriate safeguards are in place when we transfer your Personal Data across international borders.  

 

By using the Services and providing us with data, you understand and agree that your information may be transferred to and stored on servers located outside your resident jurisdiction and, to the extent you are a resident of a country other than the United States. If you use our Services outside of the United States, you consent to the transfer of your Personal Data across international borders. 

 

12.  EEA, UK, & SWISS DATA PRIVACY RIGHTS

 

If you are a resident of the EEA, UK, or Switzerland, you are entitled to certain rights. These rights include:

• Request Access - You have the right to receive a copy of the Personal Data we hold about you. 
• Request Correction - You have the right to request the correction of your Personal Data if it is inaccurate or incomplete. We may need to verify the accuracy of the new data you provide to us.
• Request Deletion - This is also known as the “right to be forgotten” and, in simple terms, enables you to request the deletion or removal of your information. We may not always be able to comply with your request for deletion for specific legal reasons, which will be notified to you, if applicable, at the time of your request.
• Object to Processing - You have the right to object to certain types of processing, including processing based on our legitimate interests and processing for direct marketing. In some cases, we may demonstrate that we have compelling legitimate grounds to process your data which override your rights and freedoms.
• Request Restriction of Processing - You may request that we stop processing your Personal Data temporarily if:
  • You do not think your data is accurate;
  • The processing is unlawful, but you do not want to erase your data;
  • We no longer need the Personal Data for our processing, but you need the data to establish, exercise, or defend legal claims or
  • You have objected to the processing because you believe your interests should override our legitimate interests.

• Request the Transfer - You have the right to transfer your Personal Data to you or a third party. We will provide your Personal Data in a structured, commonly used, machine-readable format to you or a third party you have chosen. Note that this right only applies to automated information you initially provided consent for us to use or where we used the information to perform a contract with you.
• Withdraw Consent at Any Time - If you have given your consent to anything we do with your Personal Data, you have the right to withdraw your consent at any time (although if you do so, that does not mean anything we have done with your Personal Data with your consent up to that point is unlawful.) If you withdraw your consent, we may be unable to provide you with certain products or services. We will advise you if this is the case at the time you withdraw your consent.
• You may also have the right to claim compensation for damages caused by our breach of any data protection laws.

We process Personal Data on the following legal bases: (1) with your consent; (2) as necessary to perform our agreement to provide Services; and (3) as necessary for our legitimate interests where those interests do not override your fundamental rights oppo and freedom related to data privacy. We may also process personal information as necessary to comply with legal obligations. Information we collect may be transferred to, stored, and processed in the United States or any other country where we, our affiliates or subcontractors maintain facilities as described above.

 

Users that reside in the EEA, UK, or Switzerland have the right to lodge a complaint about our data collection and processing actions with the supervisory authority concerned. Contact details for data protection authorities are available here.

 

13.  WHAT WE MAY NEED FROM YOU

 

Where you wish to exercise one of the rights listed above in the data privacy rights sections, we may need to request specific information from you to help us confirm your identity and ensure your right to access your Personal Data (or to exercise any of your other rights). This is a security measure to ensure that Personal Data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

 

Where we are not able to determine with any degree of certainty whether the information requested by you relates exclusively to you, our disclosure of such information to you may pose a privacy risk to a third party (for example, where a cookie is associated with a device used by more than one person). We will assess each request to exercise any of the rights listed above individually on its merits and will disclose the requested information where we are satisfied that such disclosure does not represent a privacy risk to any third party.

 

14.  CHANGE OF PURPOSE

 

We will only use your Personal Data for the purposes for which we collected it unless we reasonably consider that we need to use it for another reason, and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us.

 

If we need to use your Personal Data for an unrelated purpose, we will notify you (if we have collected your Personal Data from you directly), and we will explain the legal basis which allows us to do so.

 

Please note that we may process your Personal Data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.

 

15.  THIRD-PARTY LINKS

 

The Services may include links to third-party websites, plug-ins, and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements. For example, if you post something on Facebook (even though we communicate with you on Facebook), that information is governed by the privacy policy on Facebook’s website. When you leave our Services, we encourage you to read the privacy policy of every website you visit. 

 

16.  OUR POLICY CONCERNING CHILDREN
